Addendum 3 — Young Workers (Under 18)
Attaches to: Template A or Template B, for any worker under 18 years of age at the date of engagement, until the day before their 18th birthday. Status: Draft for Zoe's review.
This addendum reflects the additional protections for young workers under the Working Time Regulations 1998 (as amended), the Children and Young Persons Acts, and the Management of Health and Safety at Work Regulations 1999.
If anything in this addendum conflicts with the main contract, this addendum prevails for as long as you are under 18.
Y1. Parental / guardian consent
Y1.1 As you are under 18, your parent or legal guardian must co-sign this addendum to confirm awareness and consent to your engagement.
Y2. Working hours
Y2.1 You will not be required to work more than:
- 8 hours per day
- 40 hours per week
Y2.2 Hours include time spent training that is part of your role. Y2.3 You may not opt out of these limits (unlike adult workers under the Working Time Regulations).
Y3. Rest breaks and rest periods
Y3.1 In-shift break: if your shift is longer than 4.5 hours, you are entitled to an uninterrupted rest break of at least 30 minutes. Y3.2 Daily rest: you must have at least 12 consecutive hours of rest between the end of one shift and the start of the next. Y3.3 Weekly rest: you are entitled to 2 days off in each 7-day period (which may, exceptionally, be reduced to 36 hours where justified by technical or organisational reasons).
Y4. Night work
Y4.1 You may not work between 10:00pm and 6:00am, except in limited circumstances allowed by law where adult supervision is provided. Y4.2 The Company will not schedule you for night shifts. If you are asked to start before 6am or finish after 10pm, you may decline without consequence.
Y5. Restricted tasks
Y5.1 You will not be required to:
- Operate dangerous machinery (mixers, slicers, ovens at full operating temperature) without direct adult supervision and prior training
- Lift loads beyond your physical capacity
- Work in conditions involving extreme temperature, noise, or vibration
- Handle hazardous substances beyond those normally found in a bakery environment
Y5.2 A specific young person's risk assessment has been completed for your role. You will be provided with a copy.
Y6. Alcohol and tobacco
Y6.1 You must not handle, sell, or be supplied alcohol or tobacco products in the course of your work.
Y7. Training and supervision
Y7.1 You will be assigned a supervisor responsible for your training, supervision, and welfare. Y7.2 You will receive induction training appropriate to your age and inexperience before being asked to perform any task.
Y8. Pay
Y8.1 You are entitled to at least the National Minimum Wage rate for your age band. The Company will increase your rate automatically when you move into a higher age band (e.g. on your 18th birthday, on 1 April rate revisions).
Y9. Transition at 18
Y9.1 On your 18th birthday, this addendum ceases to apply. The full terms of your main contract take effect, including adult working time provisions. Y9.2 Your pay will be adjusted to the applicable adult minimum wage if not already higher.
