Addendum 1 — Drivers
Attaches to: Template A (Employment Contract) for any role that involves driving a Company vehicle on Company business. Status: Draft for Zoe's review.
This addendum forms part of your contract of employment. If anything in this addendum conflicts with Template A, this addendum prevails for matters within its scope.
D1. Licence
D1.1 You must hold a current, valid UK driving licence appropriate to the category of vehicle you are required to drive. D1.2 You consent to the Company carrying out annual licence checks via the DVLA share code service. D1.3 You must notify the Company immediately of:
- Any endorsement, penalty points, ban, or licence suspension
- Any court summons or charge for a driving offence
- Any medical condition that affects your fitness to drive
- Any expiry or cancellation of your licence
D1.4 Failure to disclose any of the above is a disciplinary matter and may result in dismissal.
D2. Insurance and Motor Insurance Database (MID)
D2.1 The Company insures its vehicles. You will be a named driver where required. D2.2 You must not drive a Company vehicle if not insured to do so.
D3. Driver hours, breaks and working time
D3.1 You must comply with all applicable driver hours rules (Working Time Regulations and, where relevant, EU/GB Drivers' Hours Rules). D3.2 You must take all statutory breaks. The Company will not require or expect you to drive in breach of any driving hours rule. D3.3 Minimum call-out payment. If you are asked to attend a shift outside your normal rota (an "ad-hoc" or emergency call-out), the Company will pay you a minimum of 3 hours at your normal hourly rate for that attendance, even if the actual work takes less. This applies to: short-notice runs to cover a sick driver, emergency deliveries, and any other unplanned attendance you are asked to accept. It does not apply to your scheduled rota shifts of less than 3 hours, which are paid for actual hours worked.
D4. Vehicle use
D4.1 Company vehicles are for Company business only unless personal use is expressly authorised in writing. D4.2 You must carry out a daily walk-around check before driving and report any defects. D4.3 You must not drive under the influence of alcohol, illegal drugs, or any medication that affects driving ability. The Company reserves the right to test on reasonable suspicion. D4.4 No smoking, vaping, or use of handheld devices in Company vehicles at any time. D4.5 You must follow Company fuel card rules and submit receipts as required.
D5. Accidents and incidents
D5.1 You must report any accident, collision, near-miss, or damage to a Company vehicle to your line manager on the day it happens, before the end of your shift where possible. D5.2 You must complete the Company's accident report form within 24 hours. D5.3 At the scene of an accident: stop, exchange details, take photographs, and (if injury or serious damage) call the police.
D6. Conduct on the road
D6.1 You represent the Company while driving Company vehicles. You must drive courteously and obey all traffic laws. D6.2 Speeding fines, parking fines, and traffic offences incurred during personal driving in a Company vehicle are your personal liability. Fines incurred while on legitimate Company business may, at the Company's discretion, be paid by the Company except where the fine results from your serious misconduct.
D7. Bus lane / congestion / low-emission zone charges
D7.1 You are responsible for awareness of restrictions (bus lanes, LEZs, congestion zones) on your route. Charges arising from avoidable breaches may be recovered from you.
D8. End of shift
D8.1 You must return the vehicle to the agreed location, lock it, and return keys to the designated place. D8.2 You must leave the vehicle in a clean and tidy condition.
D9. Termination of driving duties
D9.1 If your licence is revoked, suspended, or otherwise rendered invalid such that you cannot drive Company vehicles, the Company may:
- Suspend you on no pay until the licence is reinstated, or
- Move you to non-driving duties if available, or
- Terminate your employment, subject to the Disciplinary Procedure.
